Terms of Use

These terms are an agreement between you and AICryptoXpert LLC, a Wyoming limited liability company ("we", "us"), which operates PicToClips (the "Service"). By using the Service you agree to these terms, the Acceptable Use Policy and the Privacy Policy.

1. Who can use the Service

You must be at least 18 years old and able to form a binding contract. One person per account. You're responsible for everything done with your account and for keeping access to your email secure.

2. Your uploads and your responsibility

You may only upload images and audio that you own or have permission to use, and you must have permission from every identifiable person shown. You are solely responsible for what you upload, the prompts you write, the videos you create and how you use, share or sell them. You must follow the Acceptable Use Policy and all laws that apply to you, including laws on privacy, publicity rights, defamation, intellectual property and intimate images.

You keep whatever rights you have in your uploads. You give us a limited license to process them only to provide the Service, for example sending your image to our AI provider to create your video.

3. Your videos

As between you and us, you may use videos you create for any lawful purpose, including commercially, subject to these terms and the rights of others in your source material. AI output can be unpredictable and may resemble existing content. We don't guarantee that output is unique or free of third-party rights. Clearly label AI-generated videos of real people as AI-generated when you share them.

4. Credits, packs and plans

• AI videos use credits. The credit cost is shown before you generate.
• Credit packs are one-time purchases. Pack credits don't expire while the Service operates.
• Monthly plans renew automatically each month until you cancel. Plan credits are added after each successful payment and roll over while your plan is active. You can cancel anytime from your account. Cancelling stops future renewals, and you keep credits already added.
• If a video fails or is blocked by a safety filter, its credits are returned automatically.
• Credits have no cash value, can't be transferred and aren't refundable except where required by law or where we decide otherwise. Credits on accounts closed for breaking these terms are forfeited.
• We may change prices and credit costs in the future. Changes don't affect credits you already have.
• Payments are processed by Stripe. Filing a chargeback instead of contacting us may lead to suspension of your account.

5. Free studio

The free studio runs in your browser. Videos made on the free tier may include a small watermark. Removing or hiding the watermark is not allowed.

6. Safety, moderation and removal

We and our providers use automated filters and may block, refuse or remove content, and suspend or close accounts, that we believe break these terms or the law, with or without notice. We respond to reports through our report page and remove unlawful intimate images and similar content within 48 hours of a valid request. We may share information with law enforcement where required by law or to protect someone's safety.

7. Third-party services

AI videos are generated by third-party AI models through our providers. Their availability, quality and speed can change, and models may be replaced or removed.

8. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't promise the Service will be uninterrupted or error-free, or that any output will meet your needs.

9. Limitation of liability

To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months before the claim.

10. Indemnity

You agree to defend and compensate us for any claims, losses and costs (including reasonable legal fees) that come from your uploads, your prompts, your videos, how you use them, or your breaking these terms or the law.

11. Changes and ending

We may update these terms. If changes are significant we'll let you know on the site or by email. Continuing to use the Service means you accept the new terms. You can stop using the Service anytime. We may suspend or end the Service or your access at any time.

12. Law and disputes

These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us and try to resolve it informally for at least 30 days.
